When is an employer legally required to settle FnF?

Payment of Wages Act, 1936

Under Section 5, wages must be paid within 7–10 days of the last day of the wage period. Courts have held that FnF constitutes wages due, making delays actionable under this Act.

State Shops & Establishments Acts

Every Indian state has its own S&E Act that governs the conditions of employment, including the obligation to settle dues and issue documents upon separation. Our generator automatically picks the right act for your employer's state.

The 45-day standard

While law requires payment within 7–10 days, courts have upheld 30–45 days as a reasonable industry standard for FnF processing. Beyond 45 days, the employer has no reasonable defence for delay.

What happens if they ignore this letter?

You can file a complaint with the Labour Commissioner — free of cost — who has the power to direct payment plus compensation up to 10x the delayed amount under Section 15 of the Payment of Wages Act.
