Victorian Payslip Requirements Under Fair Work Law

In Victoria, payslip obligations are governed by the Fair Work Act 2009 and Fair Work Regulations 2009. Almost all Victorian employers are covered by the national workplace relations system, meaning they must issue a payslip to every employee within one working day of each pay day.

This obligation applies to full-time, part-time, casual, and fixed-term employees. Non-compliance can result in civil penalties of up to $16,500 per contravention for an individual employer.

VIC Minimum Wage 2026 — What to Show on Payslips

The national minimum wage — which applies to Victorian employees not covered by a higher Modern Award or Enterprise Agreement — was set at $24.10 per hour or $915.90 per standard 38-hour week (before tax) from 1 July 2025, following the Fair Work Commission's Annual Wage Review.

Many Victorian workers are covered by Modern Awards (e.g. the Clerks Award, Retail Award, Hospitality Award, Building and Construction Award), which set higher minimum rates than the national floor. Always cross-check the relevant Award for your industry at fairwork.gov.au.

Overtime in Victoria under most Awards is paid at time and a half for the first 2 hours and double time thereafter. These amounts must appear as separate line items on the payslip, distinct from ordinary time earnings.

Long Service Leave in Victoria — Payslip Reporting Rules

Victoria operates under its own long service leave legislation — the Long Service Leave Act 2018 (Vic) — which is more generous than the national framework and applies to most Victorian employees regardless of their Award.

Under this Act, employees accrue long service leave at a rate of 1/60th of their period of continuous employment with the same employer. This means after 7 years of continuous service, an employee is entitled to approximately 6.1 weeks of long service leave — and the entitlement can be taken (or paid out on termination) from that point.

When an employee takes long service leave or receives a long service leave payout, the payment must be clearly identified on their payslip as a separate line item — distinct from ordinary time earnings, annual leave, and other entitlements.

Victoria Public Holidays 2026 — Payslip & Payroll Impact

When Victorian employees work on public holidays, employers must pay penalty rates as set by the employee's Modern Award or Enterprise Agreement. The standard rate is double time and a half (250%) of the ordinary rate for most Awards. Note that Melbourne Cup Day is a unique Victorian public holiday that applies only to the Melbourne metropolitan area — regional Victorian employees may not be entitled to it unless their Award specifies otherwise.
